Interviewing a candidate from Clementines Au pairs and Nanny Agency will indicate acceptance of both the fee structure and terms & conditions.
Clementines Au pairs and Nanny Agency candidates are covered by a 6 Months replacement guarantee warranty agreement.
The Agency operates as an introduction Agency only between Clients and Candidates. At all times after engagement, the Candidate is under the Client’s supervision, control and responsibility. Candidates are not employed by the Agency either directly or indirectly and the Agency cannot be responsible to the Client or any other person for any damage, loss, or expense incurred either directly or indirectly by reason of the negligence or shortcomings of any Candidate employed by a Client while the Candidate is performing duties or while travelling in a car with the children.
The use of a third party to "recruit" a candidate, in order to avoid the payment of fees will incur a similar charge.
The client is required by law to have a contract of employment with the candidate, with which Clementines Au pairs and Nanny Agency will assist you with.
Clementines Au pairs and Nanny Agency will take all reasonable care to ensure the suitability of the candidate; it is the Client’s responsibility to satisfy him or herself before offering the position - the final decision to accept the candidate remains with the Client.
Placement Fee
Interviewing a candidate from Clementines Au pairs and Nanny Agency will indicate acceptance of both the fee structure and terms & conditions.
Clementines Au pair and Nanny Agency candidates are covered by a 6 Months replacement guarantee warranty agreement.
Please note that by filling in and submitting the Family Application Forms to Clementines Au pairs and Nanny Agency you are acknowledging all fee’s and conditions as laid out in both the Terms and Conditions and the Family Form, whether or not they have been signed in full.
Once both Client and Candidate have accepted and agreed upon all terms and conditions of employment, either verbally or in writing, placement fees will be due and a Placement Fee Invoice will be issued.
In accordance with the Labour Relations Act, a Child Care Contract of Employment will be made available, and a copy once signed in full by both parties is to be forwarded to our offices at Clementines Au pairs and Nanny Agency for our records.
No Candidate will be permitted to continue working for the Client if all Agency Placement Fees have not been paid in full, as laid out in our terms and conditions.
It is your choice if you prefer to pay the whole fee upfront however the total fees due are to be paid before the nanny commences work.
By submitting the application form either by email, you accept our terms and conditions, whether or not the document has been signed in full.
Should the placement fee not be settled within 7 days of the placement a late payment penalty of R50.00 per day will be levied until such time as fees are settled.
In the event of failing to make payment on due date as aforesaid, the full placement fee together with costs and interest will become due and payable without further notice.
Guarantee Period
We will provide a 6 Months replacement guarantee period where Clementines Au pair and Nanny Agency will replace the nanny free of charge if the client is dissatisfied or if the nanny leaves/discharged for any reason.
Should the nanny cancel the contract prior to start date for whatever reason the Agency will endeavor to arrange a replacement and propose an alternative suitable candidate.
Clementines Au pair and Nanny agency quality guarantee extends for a period of 6 Months from start date. If during this period, an nanny decides to leave her family, Clementines Au pair and Nanny Agency undertakes to replace the candidate free of charge, provided that the placement fee was paid
Within 7 days of the nanny's commencement date.
Should Clementines Au pair and Nanny Agency not be given the opportunity to replace a candidate and/or make alternative arrangements via another source, this guarantee will be regarded as having been completely discharged. Neither will a refund be given if the Client no longer wishes to hire a nanny, regardless of the reason.
Please Note that Clementines Au pair and Nanny Agency’s Quality guarantee specifically excludes:
• Retrenchment.
• Unfair dismissal.
• Breach of employment contract by the employer.
A replacement nanny will only be provided to Clients having paid before the start date & where the Agency has received written notification within 48 hours stating that the employment has been terminated.
Should a placement terminate after 6 Months, the Agency is not obliged to offer a refund or free replacement. No refunds will be
made on replacement of nannies.
Liability Clause
Clementines Au pair and Nanny Agency acts as an intermediary only and is not the employer. The Client must ensure they are 100% sure of the suitability of the nanny prior to hiring them – Clementines Au pair and Nanny Agency is not responsible if the nanny proves to be unsuitable. The choice of nanny remains the Client’s decision, the client accepts these terms and conditions, whether or not they sign the form and/or the conditions.
In accordance with the Labour Relations Act, the Client is required to have a Contract of Employment with the Candidate and to comply with all the legislative conditions including, but not limited to all statutory deductions to be made by the client. A Contract of Employment will be supplied upon offer of employment being accepted by the candidate.
This agreement constitutes a full and binding contract between the Agency and the client. The client signifies their agreement to the terms and conditions.
